Terms of Service

1. Agreement to the Terms

These Terms of Service (“Terms”) govern your use of Matched in Miami (the “Service”), operated by Iconic Media Group, LLC (“we,” “us,” or “our”). By creating an account or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility — Age 18+

You must be at least 18 years old to use the Service. By using it, you represent that you are 18 or older and legally able to enter into agreements. We use your date of birth to verify eligibility; providing a false date of birth may result in immediate account removal.

3. Account Creation and Security

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You may not share, transfer, or sell your account. Notify us promptly of any unauthorized use. We may suspend or close accounts that are compromised or used in violation of these Terms.

4. Google and Social Authentication

You may create or access your account using Google (or other providers we enable). When you do, authentication is handled by that provider. We receive only the minimum account data described in our Privacy Policy (such as your email, name, and profile image). We do not receive your provider password. You may revoke our access at any time from your provider’s settings. Your use of Google is also governed by Google’s terms.

5. Dating-Service Nature of the Platform

Matched in Miami is a dating and social discovery service. It is intended to help adults meet and connect. It is not a guarantee of any outcome. Your safety and conduct — online and in person — are ultimately your responsibility.

6. No Guarantee of Matches, Compatibility, Identity, Conduct, Safety, or Outcomes

We do not guarantee that you will receive matches, that any match will be compatible, that another user is who they claim to be, or that any interaction or in-person meeting will be safe or successful. Compatibility scores, AI suggestions, and recommendations are informational only. You are responsible for verifying information and protecting yourself.

7. Profile Visibility and Your Choices

You choose whether your profile is public or private. Public profiles appear in Browse Singles; private profiles appear only to AI matches, mutual Secret Crush matches, and existing matches. You can change this in Settings. Until you choose, your profile is excluded from discovery.

8. Acceptable Conduct

You agree to interact respectfully and lawfully. You will:

• Treat other users with respect
• Provide accurate information about yourself
• Respect other users’ boundaries and consent
• Comply with these Terms and our Community and Safety Guidelines

9. Prohibited Conduct and Content

You may not use the Service to:

• Harass, threaten, stalk, intimidate, or harm anyone
• Impersonate another person or misrepresent your identity, age, or attributes
• Solicit money, run scams, or promote commercial activity without authorization
• Share sexual content involving minors or non-consensual intimate content
• Post hate, discrimination, or content that incites violence
• Use the Service for any illegal purpose

Violations may result in content removal, restriction, or account termination.

10. Messaging and Community Features

Messaging, posts, comments, and other community features are provided to help you connect. You are responsible for what you send. We may limit, suspend, or remove access to these features for conduct that violates these Terms. Private messages may be accessed by authorized administrators only for legitimate safety investigations, as described in our Privacy Policy.

11. User-Generated Content

You are responsible for the content you create or share. You represent that you have the rights to any content you upload and that it does not violate these Terms or any law. We may remove content that violates these Terms or that we determine is harmful.

12. Content Ownership and Limited Service License

You retain ownership of your content. By sharing it on the Service, you grant us a limited, worldwide, non-exclusive, royalty-free license to host, display, reproduce, and distribute your content solely as needed to operate and improve the Service. This license ends when you delete your content or your account, except where content remains in legitimate safety or legal records.

13. AI Matches, Compatibility Scoring, and Recommendations

Match suggestions, compatibility scores, and recommendations are generated by automated systems and are provided for information only. They are not guarantees of compatibility or suitability. We are not liable for matches, recommendations, or outcomes based on them.

14. Browse Singles and Affinity Signals

Browse Singles lets public profiles be discovered organically. We may use aggregated affinity signals (such as the types of profiles you tend to interact with) to improve discovery and matching. These signals do not constitute a raw record of every profile you viewed and are used only to improve match quality.

15. Secret Crush and Related Features

Secret Crush lets you privately express interest. A match is revealed only if the interest is mutual. Your Secret Crush selections are private unless a mutual match occurs. We are not liable for the outcomes of Secret Crush or related features.

16. Events, Date Ideas, Date Plans, and Third-Party Venues

Events, date ideas, and date plans may reference third-party venues and services we do not control. Venue availability, pricing, and safety are the responsibility of those third parties. We may provide links or maps for convenience and are not responsible for the accuracy or availability of third-party venues.

17. In-Person Meetings and Safety Responsibilities

If you meet another user in person, you are responsible for your own safety. We encourage you to review our Safety Guidelines, meet in public, tell someone you trust, and never share financial or sensitive personal information. We are not a party to any off-platform interaction and are not liable for off-platform conduct or outcomes.

18. Blocking, Reporting, Moderation, and Administrative Access

You may block users and file reports through the Service. We may investigate reports and take action — including content removal, restriction, suspension, or termination. Where needed for a legitimate safety investigation, authorized administrators may access private message evidence; such access is audit-logged, as described in our Privacy Policy.

19. Account Suspension and Termination

We may suspend or terminate your access to the Service if you violate these Terms or for any legitimate business or safety reason. You may stop using the Service at any time and may delete your account at any time (Section 20).

20. Account Deletion

You may delete your account at any time from Settings. Account deletion disables discovery and removes your profile. Certain information may be retained where necessary for safety, fraud prevention, legal compliance, billing, or dispute resolution, as described in our Privacy Policy. If you signed in with Google, you should also revoke our access in your Google account settings.

21. Intellectual Property

The Service, including its branding, software, and design, is owned by us and our licensors and protected by intellectual property laws. You may not copy, modify, or distribute it except as needed to use the Service. Your content remains yours as described in Section 12.

22. Third-Party Services

The Service integrates with third-party services (such as Google, maps, events, and payments). These services are governed by their own terms. We are not responsible for their behavior, availability, or policies.

23. Service Availability and Changes

We do not guarantee uninterrupted or error-free availability. We may change, suspend, or discontinue any feature at any time. We may update these Terms from time to time; material changes will be reflected in the “Last Updated” date and, where appropriate, communicated to you. Continued use after changes take effect constitutes acceptance.

24. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be error-free, secure, or that matches or outcomes will result.

25. Limitation of Liability

To the maximum extent permitted by law, neither we nor our affiliates, officers, employees, or partners will be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, matches, or relationships, arising out of or related to the Service. Our total liability for any claim is limited to the amount, if any, you paid us to use the Service in the prior twelve months.

26. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, and expenses arising out of your content, your conduct, or your violation of these Terms, to the extent permitted by law.

27. Governing Law

These Terms are governed by the laws of Florida, without regard to conflict-of-law principles. You and we submit to the jurisdiction of the State and federal courts located in Hollywood, Florida for any dispute arising from these Terms or the Service.

28. Dispute Resolution

Any dispute arising from these Terms or the Service will first be addressed by good-faith negotiation. If not resolved, disputes will be resolved through the State and federal courts located in Hollywood, Florida. This does not limit either party’s right to seek injunctive relief to protect intellectual property or safety.

29. Changes to the Terms

We may update these Terms from time to time. We will revise the “Last Updated” date above. Your continued use after changes take effect constitutes acceptance. If required by law, we will notify you of material changes.
